Agreement to Terms
Welcome to Zaviera. These Terms of Service ("Terms") govern your access to and use of the Zaviera mobile application ("App", "Service", or "Platform"). By accessing or using Zaviera, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Service.
Eligibility
You must be at least 13 years old to use Zaviera. By using the Service, you represent and warrant that:
- You are at least 13 years of age
- You have the legal capacity to enter into these Terms
- You will comply with these Terms and all applicable laws
- You have not been previously suspended or removed from the Service
If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
Account Registration
To use certain features of Zaviera, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You may not use another person's account without permission or create multiple accounts.
User Content
Your Content
Zaviera allows you to create, upload, and share content including videos, photos, comments, and other materials ("User Content"). You retain ownership of your User Content, but by posting it on Zaviera, you grant us certain rights.
License to Your Content
By posting User Content on Zaviera, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and our business operations.
This license continues even if you stop using the Service, but you can terminate it by deleting your content or account.
Content Standards
You agree that your User Content will not:
- Violate any laws or regulations
- Infringe on intellectual property rights of others
- Contain hate speech, harassment, or bullying
- Include sexually explicit or pornographic material
- Promote violence or dangerous activities
- Contain spam, malware, or deceptive content
- Impersonate others or misrepresent your affiliation
- Violate the privacy rights of others
Content Moderation
We reserve the right to review, monitor, and remove User Content that violates these Terms or is otherwise objectionable. However, we are not obligated to monitor all content and are not responsible for User Content posted by others.
Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers
- Use automated systems (bots, scrapers) without permission
- Collect or harvest information about other users
- Reverse engineer or attempt to extract source code
- Sell, rent, or commercialize the Service without authorization
- Create accounts through unauthorized means
- Circumvent any security features or access restrictions
Intellectual Property Rights
Our Rights
The Service and its original content (excluding User Content), features, and functionality are owned by Zaviera and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Trademarks
Zaviera, our logo, and any other product or service names or slogans displayed on the Service are trademarks of Zaviera and may not be used without permission.
Copyright Infringement
We respect intellectual property rights. If you believe that content on Zaviera infringes your copyright, please contact us at support@zaviera.com with:
- Description of the copyrighted work
- Location of the infringing material
- Your contact information
- A statement of good faith belief
- A statement of accuracy under penalty of perjury
- Your physical or electronic signature
Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Termination
By You
You may delete your account at any time through the app settings. Upon deletion, your User Content will be removed from public view, though some information may be retained as required by law or for legitimate business purposes.
By Us
We may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including if:
- You violate these Terms
- Your conduct harms other users or Zaviera
- We are required to do so by law
- We discontinue the Service
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- Any errors in the Service will be corrected
- The Service will meet your requirements
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAVIERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the past twelve months, or $100, whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless Zaviera and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any rights of another party
Dispute Resolution
Informal Resolution
If you have a dispute with us, please contact us at support@zaviera.com and we will attempt to resolve it informally.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Zaviera operates, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
General Provisions
Entire Agreement
These Terms constitute the entire agreement between you and Zaviera regarding the Service and supersede all prior agreements.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
